Utah Closing Costs: Who Pays What at Closing

Utah has no transfer tax and a flat $40 recording fee. A plain-English breakdown of Utah buyer and seller closing costs and who customarily pays them.

Utah is one of the least expensive states in the country to close a real estate transaction. There is no state or county transfer tax, there is no mortgage or intangible tax, and recording a document costs a flat $40. Most of what you pay at a Utah closing is title insurance, escrow fees, lender charges and prorated property taxes.

What the seller usually pays

  • The standard owner’s title insurance policy. In Utah the seller customarily provides the buyer with a standard coverage owner’s policy at the purchase price.
  • Half of the escrow (closing) fee, in most transactions.
  • Real estate commissions, as agreed in the listing agreement.
  • Mortgage payoffs and the $40 fee to record each release.
  • Property taxes from January 1 to closing. Utah taxes are paid in arrears (due November 30), so the seller credits the buyer for the part of the year they owned the home.

Why Utah title premiums differ between companies

Utah title insurance rates are filed with the Utah Insurance Department by each underwriter, so the price of the same policy can vary between title companies.
